GENERAL TERMS AND CONDITIONS
1. General Terms
These Terms of Purchase are part of the Seller's obligation under the Consumer Protection Act and are intended to inform the Buyer, in a clear and understandable manner, of various essential conditions before concluding a distance contract, all in accordance with legal provisions.
The term "Seller" refers to Dilvija, a textile production and finishing business owned by Diana Butković and Silvija Butković, located at Podšupera 21, 51260 Crikvenica, VAT ID: 79076200861, website: babamara.com.
The term "Buyer" includes both: individual consumers (natural persons who order and pay for any product outside of any business activity via the Seller's online store) and corporate buyers, entrepreneurs, traders, and individuals who conduct business activities. However, corporate buyers are protected by the Consumer Protection Act only if they purchase products unrelated to their business activities.
The Seller acts in its own name when selling products via the website babamara.com.
The Terms of Purchase constitute a part of the distance contract, along with the specifications and price(s) of the purchased product(s). Before confirming an order, the Buyer will be asked to accept these terms/confirm that they are aware of and agree to them. After the order is confirmed (contract concluded), the terms will be sent to the Buyer as part of an email confirming the contract’s conclusion. The Seller reserves the right to change the terms at any time, with any changes taking effect after being published on this website.
Once the Buyer confirms and completes an order, the contract is concluded, and the Seller will immediately notify the Buyer via email of the contract’s conclusion. Only a person with full legal capacity can validly conclude the contract.
The Buyer is responsible for the accuracy and truthfulness of the data entered during registration.
The Terms of Purchase are divided into categories/information below.
2. Product Specifications and Properties
Product prices are listed in euros and do not include VAT per Article 90 of the Croatian VAT Law.
The Buyer agrees to carefully review product specifications before making a purchase and to raise any questions or concerns about the product before purchasing.
The Seller will strive to ensure that all product specifications, including dimensions, material, colors, and other relevant details, are clearly stated on the online store.
Despite efforts to provide accurate information, the Seller cannot guarantee that product specifications will fully match the product as seen in photos due to the handmade nature of products, the Buyer’s monitor settings, color perception differences, etc.
3. Orders and Purchase of Products
All products are made to order after payment is completed. Production time for products ranges from 2 to 5 days.
Products are ordered by selecting them, using the menu, and filling out the electronic form. A product is considered ordered when the Buyer completes the entire ordering process.
Payment for ordered products can be made as follows:
- Bank transfer
- General payment slip
For payments via general payment slip or e-banking, payment must be made within the period indicated in the email confirming the contract.
If the Buyer does not receive confirmation of the contract’s conclusion after completing the order process, they should check:
- Whether the email is in the Junk/Spam folder
- Whether their mailbox is full
If payment is not completed within the specified period, the Seller will proceed with any delayed payment by delivering the purchased products. If the Seller cannot deliver the product for valid reasons, the contract will be terminated, and a refund will be issued.
If the payment is properly made and visible on the Seller's account, the Seller will proceed with the production of ordered products.
Ordered products are delivered via various local delivery services, with delivery occurring no later than 7 business days from the date payment is visible on the Seller's account. If the selected product cannot be delivered because it is unavailable, the Seller must immediately inform the Buyer, who has the right to terminate the contract and request a refund or agree to a delayed delivery date.
We aim to deliver all ordered items in a single package. If stock availability prevents this, we reserve the right to deliver in multiple shipments.
4. Delivery
Delivery costs within Croatia amount to EUR 5. Delivery costs for the EU and other countries are EUR 10.
If delivery to the address provided by the Buyer is unsuccessful, the Buyer will bear the costs of redelivery to the same or a different address, depending on the information provided to the Seller during delivery verification.
5. Returns and Exchanges
The Buyer is entitled to return or exchange a product (except products made to order) within 14 days of receiving the product. The Buyer must submit a request for return or exchange via the general contact form (Contact) or by email within this period.
Products must be unused, undamaged, and returned in their original packaging.
Return shipping costs are borne by the Buyer, except if the return is due to a mistake by the Seller.
6. Product Liability
The Seller is responsible for product quality during the manual creation of each product, after production, and before shipment to the Buyer, including product packaging. Certain specification deviations are possible due to the handmade nature of the products.
The Buyer is responsible for the product's condition and functionality after receiving it through proper care, storage, and handling. Any damage resulting from improper handling, storage, or care is not eligible for return, exchange, or new manual production.
The Seller is not liable for any damage caused by using products purchased through the online store if caused by intentional, negligent, or reckless actions.
7. Privacy and Data Security
The Seller will protect the privacy and security of the Buyer’s personal data in accordance with the Croatian Personal Data Protection Act and GDPR.
All personal data of the Buyer will be used solely for communication between the Seller and Buyer, order processing, and product delivery, and will not be shared with third parties.
The privacy and data security of the Buyer are further governed by this web shop’s Privacy Policy.
8. Complaints
The Buyer has the right to file a complaint regarding the product and/or service. For all questions, complaints, or claims, the Buyer can contact the Seller via the contact form or email at babamaraprinta@gmail.com.
By using the web shop, the Buyer confirms that they have read, understood, and accepted all Terms of Use and the Seller’s General Terms and Conditions.
